Store & Digital Products Terms & Conditions of Sale
Books, resources, merchandise and digital productsThese terms apply when you buy goods or digital products from us through our online store. Your contract is made with Ricky Munday, a sole trader trading as Mental Toughness (“we”, “us”, “our”), of Claremont Street, Glasgow, G3 7HB. “You” and “your” mean the customer placing the order. Nothing in these terms affects your statutory rights as a consumer.
A. Ordering & prices
Placing an order. Your order is an offer to buy. A binding contract is made when we send you an order confirmation or dispatch the goods or digital product. If we cannot fulfil an order, we will tell you and refund any payment.
Prices. Prices are in pounds sterling and are shown at checkout, including any applicable taxes and, for goods, any delivery charge shown before you order. We are not VAT-registered, so no VAT is added to our fees. We may correct obvious pricing errors before dispatch.
Payment. Payment is taken at checkout through our payment provider. We do not receive or store your full card details.
B. Delivery of physical goods
We deliver to the addresses shown at checkout. Delivery timescales are estimates and not guaranteed. Risk in the goods passes to you on delivery; ownership passes once we have received full payment. If goods arrive damaged or are lost in transit, contact us and we will put it right.
C. Digital products
Licence. Digital products — such as workbooks, guides, downloads and online content — are licensed to you, not sold, for your personal, non-commercial use. You may not copy, share, resell or redistribute them.
Access. We provide access by download or online account as described on the product page. You are responsible for having a compatible device and internet access.
D. Your right to cancel (consumers)
Goods. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you may cancel most goods within 14 days of receiving them, and return them unused within a further 14 days, for a refund. You pay the cost of return unless the item is faulty. Certain goods are excluded, including personalised items and sealed items that have been unsealed and are not suitable for return for hygiene reasons.
Digital content. For digital products, you agree that we begin supplying the content as soon as your order is confirmed, and you acknowledge that you lose the 14-day right to cancel once download or access has begun. If you have not yet downloaded or accessed the content, you keep your right to cancel for a refund.
Refunds. Where a refund is due, we make it using your original payment method within 14 days of receiving the goods back or, for a valid digital cancellation, of your cancellation.
E. Faulty goods & your statutory rights
Under the Consumer Rights Act 2015, goods must be of satisfactory quality, as described and fit for purpose, and digital content must be of satisfactory quality. If something is faulty or not as described, contact us and we will provide a repair, replacement or refund as the law requires. These rights are in addition to the cancellation rights above.
F. General
Intellectual property. All content in our products and store — text, images, designs and materials — is ours or our licensors’ and is protected by copyright. Buying a product does not transfer any intellectual property rights to you.
Liability. Except for liability that cannot be excluded by law, our total liability in connection with an order is limited to the price you paid for it. Nothing in these terms excludes or limits your statutory rights, or our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under Scots law.
Data protection. We process your personal data in accordance with the UK GDPR, the Data Protection Act 2018 and our Privacy Policy.
Governing law. These terms are governed by Scots law, and any dispute is subject to the exclusive jurisdiction of the courts of Scotland.
