UK Events & Challenges Terms & Conditions
Single-service guiding · acting as PrincipalYour contract is made with Ricky Munday, a sole trader trading as Mental Toughness ("we", "us", "our"), of Claremont Street, Glasgow, G3 7HB. Please read these conditions carefully. "You" and "your" mean the first-named person on the booking and everyone on whose behalf the booking is made. If you book as a parent or guardian on behalf of someone under 18, you accept these conditions on their behalf.
We act as Principal providing a single service: mountain guiding and leadership on UK events and challenges. We do not sell or provide transport or accommodation as part of your booking. Where an event runs over more than one day, you arrange and pay for your own travel and accommodation directly with third parties. Because we provide only a single travel service, your booking is not a "package" under the Package Travel and Linked Travel Arrangements Regulations 2018.
By making a booking, the first-named person confirms on behalf of everyone on the booking that they: have read and agree to be bound by these terms; consent to our use of personal data in line with our Privacy Policy; are 18 or over (16–17-year-olds may take part if accompanied by a parent or guardian); and accept financial responsibility for payment.
A. Booking & payment
Making a booking — A binding contract is made when you complete the booking form, pay the registration fee, and we issue a booking confirmation. At booking you provide personal information including name, contact details, next of kin and medical information.
Entire agreement — These conditions form the entire agreement between us. Only Ricky Munday may vary these terms or agree to any discount or refund.
What is included / not included — The fee covers our guiding and leadership for the event described in your confirmation. It does not include transport to or from the event, accommodation, food and drink, personal equipment, travel/activity insurance, or any activity not described in the itinerary — these are your responsibility.
Payment — Any balance of the event fee is due at least 4 weeks before the event date. If you book within 4 weeks of the event, the full fee is payable at the time of booking. We may treat a booking as cancelled by you if payment is not received on time, in which case the cancellation charges below apply.
Group bookings — If you book for a group, you (the "lead booker") are responsible for paying the registration fee for each place and for filling those places. Registration fees are non-refundable, so a fee paid for a place you cannot fill will be lost. Refunds, where due, are made to the lead booker only.
B. Participation, medical & insurance
Participation — Participants must be suitably fit to undertake the event as described in the itinerary and should understand the risks inherent in mountain activities.
Medical declaration — You must disclose any medical condition or disability that may affect your participation on our Medical Declaration & Participation Agreement. We treat this information confidentially. If we reasonably believe we cannot safely accommodate your needs, we may decline or cancel your booking.
Insurance — We strongly recommend you take out suitable travel/activity insurance when you book, covering cancellation, injury and personal equipment.
C. On the event
Authority of the leader — You agree to follow the reasonable instructions of the leader relating to the safety and organisation of the event. If the leader reasonably considers that you are not sufficiently fit, healthy or equipped, or that your behaviour affects the safety, comfort or progress of the group, the leader may remove you from the event at any stage, and no refund will be due.
Emergency medical treatment — In an emergency, you authorise us to arrange any necessary medical treatment and to sign any required consent on your behalf where you are unable to do so.
Risk & flexibility — Mountain activities are not without risk and you take part at your own volition. Itineraries are an indication of what the group should accomplish, not a contractual guarantee; delays and reasonable changes are possible, and safety is paramount.
Behaviour — You must behave appropriately and comply with the law. If your behaviour causes danger, distress or damage, we may end your participation with no refund, and you agree to indemnify us for any resulting claim or cost.
Media — Unless you tell us otherwise in writing, you consent to photographs and video that may include you being used in our publicity and on social media.
D. Changes & cancellations
Cancellation by you — Cancellation must be notified in writing and takes effect on the day we receive it. The registration fee is non-refundable. In addition, the following charges apply to the event fee:
28 days or more before the event: loss of registration fee only.
14 to 28 days before the event: 50% of the event fee.
Fewer than 14 days before the event: 100% of the event fee.
Minimum numbers & cancellation by us — Our events depend on a minimum number of participants. If the minimum is not met, or for reasons of safety or circumstances beyond our control, we may cancel or reschedule. If we cancel, you may choose an alternative date (where available) or a full refund of the fees you have paid to us, which is the full extent of our liability.
Changes by us — We may make reasonable changes to the itinerary, meeting point or timings for safety, weather or operational reasons. We will tell you of significant changes as soon as we reasonably can.
Force majeure — We will not be liable where our obligations are affected by events beyond our reasonable control, including severe weather, natural disaster, disease outbreak, acts of authority, civil strife or terrorism.
E. General
Complaints — If a problem arises during the event, tell the leader at once so it can be put right. If it cannot be resolved, write to us within 28 days of the event with full details and we will respond promptly.
Data protection — We process your personal data in accordance with the UK GDPR, the Data Protection Act 2018 and our Privacy Policy.
Liability — We provide our guiding services with reasonable skill and care. Except for liability that cannot be excluded by law, our total liability is limited to the fees you have paid to us for the event. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under Scots law.
Governing law — These terms are governed by Scots law, and any dispute is subject to the exclusive jurisdiction of the courts of Scotland.
