This website, rickymunday.com (the “Site”), is operated by Ricky Munday, a sole trader trading as Mental Toughness (“we”, “us”, “our”), of Claremont Street, Glasgow, G3 7HB. By accessing or using the Site you agree to these Terms of Use. If you do not agree to them, please do not use the Site.

These Terms of Use govern your use of the Site itself. They are separate from the terms that apply when you book a service or buy a product from us — those are set out in the relevant booking Terms & Conditions or Terms of Sale, which apply to that transaction.

1. Changes to these terms and to the Site

We may update these Terms of Use from time to time, and the version published on the Site at the time you use it applies. We may also change, suspend or withdraw all or part of the Site, and any content on it, without notice. We do not guarantee that the Site, or any content, will always be available or uninterrupted.

2. Using the Site

You may use the Site only for lawful purposes. You must not misuse the Site — for example by introducing malicious code, attempting to gain unauthorised access to the Site or any server, scraping or harvesting content or data by automated means, or using the Site in any way that damages it, disrupts it, or interferes with another user’s use of it. You must not use content from the Site to compile a database or to send unsolicited communications.

3. Accounts and purchases

Some features (such as the online store or member content) may require an account. You are responsible for keeping your account details secure and for activity under your account. Any purchase of a product, or booking of a service, is governed by the applicable Terms of Sale or booking Terms & Conditions, which you accept at the point of purchase or booking.

4. Intellectual property

All content on the Site — including text, articles, photographs, images, video, graphics, logos and design — is owned by us or our licensors and is protected by copyright and other intellectual property rights. You may view, download and print content for your own personal, non-commercial use. You may not otherwise copy, reproduce, republish, distribute, sell or exploit any content without our prior written permission. “Mental Toughness” as used in our branding, and our logos, may not be used without our consent.

5. Content you submit

If the Site allows you to submit content — such as comments, reviews or enquiry messages — you must ensure it is lawful, accurate, and not offensive, defamatory or infringing of anyone’s rights. You grant us a non-exclusive, royalty-free licence to use, display and reproduce content you submit in connection with the Site and our services. We may remove any submitted content at our discretion.

6. Information on the Site is general

The content on the Site — including articles, expedition and route accounts, and material about mental toughness, coaching and the mountains — is provided for general information and interest only. It is not professional, medical, psychological, financial or safety advice, and it is not a substitute for your own judgement or for advice from a suitably qualified professional.

Mountain safety. Any route descriptions, guides or expedition accounts on the Site are personal accounts and general information, not a substitute for proper training, navigation, equipment, fitness, insurance and up-to-date conditions and weather information. Hill walking, mountaineering and related activities carry inherent risks, including serious injury or death. If you act on information from the Site you do so at your own risk and remain responsible for your own safety and decisions.

No coaching or client relationship. Using the Site, or reading its content, does not create a coaching, advisory or professional relationship between us. Such a relationship arises only when we agree it in writing under the relevant service terms.

7. Links and third-party tools

The Site may link to, or embed, third-party websites and tools — for example activity, fundraising, email, checkout, course or social-media platforms. We provide these for convenience and do not control them; we are not responsible for their content, availability, or their terms and privacy practices. Your use of a third-party service is governed by that provider’s own terms.

8. Our liability

We provide the Site with reasonable care but make no warranties that it, or any content, is accurate, complete, current or free from errors or viruses. To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of, or inability to use, the Site, or from reliance on any content on it. Nothing in these Terms of Use excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under Scots law. Nothing in these Terms of Use affects your statutory rights as a consumer.

9. Privacy and cookies

We process personal data collected through the Site in accordance with the UK GDPR, the Data Protection Act 2018 and our Privacy Policy, which explains what we collect and how we use it, including our use of cookies.

10. Governing law

These Terms of Use, and any dispute arising from your use of the Site, are governed by Scots law and subject to the exclusive jurisdiction of the courts of Scotland.
